The Steps of a Civil Litigation Case

The steps of a civil litigation case can be complex and overwhelming, especially if this is your first time going through the process. That’s why it’s important to have an experienced civil litigation lawyer by your side.

Pleadings
In this step, the plaintiff files a complaint to the court while the defendant is required to respond by filing a statement of defense. In this step, the plaintiff files a complaint to the court while the defendant is required to respond by filing a statement of defense.
Discovery
Both parties are required to disclose documents and information relevant to the case. This lets each side scrutinize the evidence and claims in the case.
Trial
At this point, both parties present their arguments and evidence in court. The judge then evaluates the facts of the case and makes a judgment.
Resolution
If the defendant isn't liable then the case is dismissed. But if he or she is liable, then the judge has to provide a remedy that can include monetary, declaratory, or an injunction.
Appeal
Either party can appeal against the court's decision. The appellate court will review the evidence, testimony and arguments of the case.

Alternatives to Litigation

Avoiding the painstaking process of civil litigation is possible. Our firm can provide you with alternatives that allow both parties to settle the dispute without going to court.

Settlement
Negotiations between parties can result in out-of-court settlements. This is often the fastest method to avoid civil litigation.
Mediation
It is a process where an independent third party mediates between the two parties in order to resolve their dispute without going to court.
Arbitration
This step is similar to mediation except this requires an arbiter or panel of arbiters who will hear both sides and make a decision. The decision is binding and can be enforced by the court.
